The appeals court dismissed the case of a young man who sought Dh51,000 in damages from an insurance company for injuries sustained in an accident after a confrontation with a driver.
The man claimed in his lawsuit that the driver of the car had been at fault for a road collision that resulted in him suffering several injuries to various body parts. The insurance provider that he would later sue had coverage on the vehicle.
The man and the defendant allegedly got into a physical argument while leaving a bar. The driver instantly took off after the man seized the car, causing the latter to fall to the ground and suffer an injury.
After then, the plaintiff was taken to a hospital for medical attention. The driver of the car that caused the collision had previously been found guilty and punished.
The plaintiff claimed that the medical care he received while in the hospital resulted in side effects that seriously damaged his left eye.
This led him to file a civil complaint asking for Dh51,000 in damages from the hospital, the driver, and the insurance company that covered the car. He was seeking damages for his bodily, emotional, and monetary harm due to the accident.
The Medical Liability Committee had reported that the young man’s treatment had been error-free.
The Abu Dhabi Court of First Instance dismissed the action against the insurance company, the third defendant in the case, in an earlier decision upheld by the Abu Dhabi Court of Appeal for Family and Civil Administrative Claims.
Given that the plaintiff was hurt due to the altercation between him and the driver of the car, the decision was taken that the accident was not covered by insurance.
